1. The service
TRACKMASTER is a click-tracking and analytics platform for online marketing. It records and reports traffic, routes visitors to destinations you configure, and provides related analytics features. The service is offered in two forms: a hosted version that we operate for you, and a self-hosted license that you install on your own server. Specific features may change over time as we improve the product.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a contract to use TRACKMASTER. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that happens under your account. Notify us promptly at contact@trackmaster.my if you believe your account has been accessed without authorisation.
3. Subscriptions, billing and renewals
Paid plans are billed in advance through our payment processor, Stripe. Prices are shown in US Dollars and may exclude taxes that apply in your jurisdiction.
- Plans. Monthly, quarterly (3-month) and annual (12-month) plans are available at the prices shown on our pricing page at the time of purchase.
- Auto-renewal. Subscriptions renew automatically at the end of each term at the then-current price unless you cancel before the renewal date.
- Cancellation. You may cancel at any time; cancellation stops future renewals. Access continues until the end of the paid term.
- Refunds. Refunds are governed by our Refund Policy.
- Payment data. Card details are handled by Stripe. We do not collect or store your full card number.
4. Self-hosted licenses
If you purchase a self-hosted license, we grant you a non-exclusive, non-transferable licence to install and use TRACKMASTER on servers you control for the duration of your subscription. You may not resell, sublicense, redistribute, or publicly share the software or its source code, and you may not remove or obscure ownership notices. Updates are provided while your subscription is active. You are solely responsible for the security, hosting, backups, and lawful operation of any self-hosted installation.
5. Acceptable use
You are responsible for the traffic you send through TRACKMASTER and for the destinations and content you route visitors to. You agree not to use the service to:
- break any applicable law or regulation;
- commit fraud, distribute malware, run phishing, or deceive or mislead visitors;
- show advertising-network reviewers or automated crawlers content that differs from what real visitors receive, or otherwise circumvent the review or policy systems of any advertising or traffic platform;
- violate the terms or policies of any third-party network, advertiser, or platform you work with;
- infringe the intellectual-property or privacy rights of others;
- collect or process personal data unlawfully or without a proper legal basis;
- promote content that is harmful to minors, hateful, or otherwise prohibited by law.
We may suspend or terminate accounts that breach this section. You are responsible for ensuring that your own use of the data and features complies with the rules of the platforms you advertise on.
6. Customer data and privacy
Our handling of personal data is described in our Privacy Policy. For data about your visitors that passes through the service, you act as the data controller and we act as a processor following your instructions. You are responsible for having a lawful basis and any required notices or consents for the data you collect through TRACKMASTER.
7. Intellectual property
TRACKMASTER, including its software, design, and trademarks, is owned by CV Bangkit Maju Terus and protected by law. These Terms do not transfer any ownership to you beyond the limited rights expressly granted. Data you collect through your own use of the service remains yours.
8. Availability and changes
We work to keep the hosted service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, modify features, or discontinue parts of the service. Where reasonable, we will give notice of significant changes.
9. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the service will meet your requirements or produce any particular business result.
10. Limitation of liability
To the maximum extent permitted by law, CV Bangkit Maju Terus will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three (3) months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless CV Bangkit Maju Terus from claims, damages, and expenses arising out of your use of the service, the traffic and content you route through it, or your breach of these Terms or applicable law.
12. Termination
You may stop using the service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the service in a way that creates legal or security risk. On termination, your right to use the service ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Indonesia. Any dispute that cannot be resolved amicably will be subject to the jurisdiction of the competent courts in Kabupaten Banyumas, Central Java, Indonesia.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and, for material changes, take reasonable steps to notify you. Continuing to use the service after changes take effect means you accept the updated Terms.
